| 摘 要： | 反规避措施是国际贸易中的新贸易壁垒,是反倾销措施的延伸与发展。在石蜡蜡烛反规避案中,中国出口产品第一次遭遇了美国反规避法中的"产品轻微改变"与"产品后期开发"规则,而自美国进口的光纤产品在中国被征收反倾销税后,其轻微改变和后期开发的产品却没有得到有效制裁。因此,中国似需要尽快完善与出台针对国外进口商规避反倾销行为的具有可操作性的反规避立法。

| Abstract: | Anti-circumvention measures are emerging trade tariff in international trade and an extension and development of anti-dumping measures.2005 saw the application of the rule of minor alternation and later development in U.S.anti-circumvention law against China’s export products in paraffin candle case for the first time,while American exported optical fiber relating to minor alternation and later development was not sanctioned effectually after being imposed anti-dumping duties by China in the same year.Therefore, it is practically significant and imperative for China to bring forth operational anti-circumvention legislation. |
