| 摘 要： | 经济在发展,法价值追求并非是一成不变的。从美国银行监管的历史可以看到,银行监管法律制度的核心价值由单一的追求效率变为单一的寻求安全,再转向有安全保障的效率优先;从银行监管的法价值角度分析,效率、安全和公平是银行监管的法价值追求,银行监管的具体措施都应体现出兼顾效率、安全和公平,以效率优先的价值追求,且三者的地位随着银行业运行态势的变化而逐步变化。
