| 摘 要： | 网络技术是一把双刃剑,在给人类带来快捷便利的同时,也使网络作品的知识产权受到了严重侵害,网络侵权已成为著作权侵权案的重灾区。网络著作权应充分利用现行法律法规进行保护;构建网络环境下著作权集体管理制度;明确网络著作权侵权赔偿标准。同时,网络著作权人还可以采取控制接触作品、控制使用作品、保证支付报酬等技术措施,从而保证网络著作权不受侵害。
