公民健康权与基本医疗保险

作为一项基本人身权利,公民健康权理应得到国家的保障。但受经济发展水平、医疗资源有限性和公民健康权扩张性的制约,国家只能通过基本医疗保险提供基本医疗保障,保证公民基本健康权得以实现。在此过程中,国家要确定合理的医疗保险水平,把公民基本健康权的扩张限制在合理的范围内,合理配置有限的医疗资源,并逐步扩大医疗保险范围,规范医疗行为,既保障公民的基本健康权,又限制其不合理扩张。
