统筹城乡发展中的土地制度改革

摘    要:改变城市土地所有制结构是解决征地二律背反的可行途径,整个城乡的土地都应该按照公益性和非公益性的原则进行调整,国有土地也应该打破目前产责权利益不清的局面。农村集体土地所有权是不完全的,需要还权赋能;增减挂钩不必通过国家征地的方式来实现;应将承包地和宅基地私有或强化其物权属性;城乡宅基地应同地同权同价;节省建设用地要着眼于农村人口向大中城市的转移;同时还应科学确定土地适度规模的标准,并设立“耕地保护基金”。
