重新犯罪问题研究——主要从刑罚相关角度分析

重新犯罪是曾受刑法否定评价的犯罪个体再次危害社会，社会危害性极大，一定程度上也意味着前期刑罚改造功能和后期社会预防的不成功。本文通过分析重新犯罪问题现状、特征，探究重新犯罪之成因，借鉴国外“恢复性司法”、“刑罚社会化”等相关实践经验，以刑罚功能的法理为基础，通过刑罚权的科学配置、裁量与执行视角审视重新犯罪问题，以期找到改良路径并尝试构建防范重新犯罪的制度体系。

On Recommitment of Crimes——Analysis of Criminal Penalty

Recommitment of crimes means that some individuals who have been subjected to criminal penalty jeopardize society once again, The crime is with great hazard, and to some extent implies the failure of both reform through penalty and the following social prevention. Firstly, the paper analyzes the situation and features of recommitment of crimes, probes into the root causes, and uses for reference the relevant international judicial practices such as ＂restorative justice＂ and ＂socialization of penalty execution＂. Then based on the principles of criminal law, the paper makes a survey of the recommitment of crimes from the perspective of the reasonable scheme, application and execution of the power of criminal penalty, intends to find a better approach and tries to establish a system of preventing the recommitment of crimes.
