知识产权与技术标准相结合的趋势、法律问题与解决途径

随着世界经济向区域化、全球化方向的发展以及现代科学技术在生产、贸易中作用的日益凸现,知识产权与技术标准相结合已经成为一种不可阻挡的趋势。一方面,知识产权与技术标准相结合是技术发展和标准形成的必然结果;另一方面,知识产权与技术标准又存在本质上的差异,二者的结合难免会产生冲突,从而产生一系列法律问题。文章分析了知识产权与技术标准相结合的趋势,列举了知识产权与技术标准相结合所产生法律问题的种种表现,在此基础上,建立了一个解决这些法律问题的简易模型,并对该模型中的三条解决途径进行了实证分析。

With the regionalization and globalization of world economy development,modern science and technology become more and more important in production and trade.The combination of intellectual property and technical standards becomes an unstoppable trend.On the one hand,it is an inevitable result of technology development and the formation of standard.On the other hand,there are essential differences between intellectual property and technical standards.Combination of them will inevitably lead to confliction and result in a series of legal issues.The article first analyzes the trend of combination of intellectual property and technology standards,and then lists legal problems created by combination of them.On this basis,the author establishes a simple model for solving these Law Problems,and makes an analysis on the three solution paths in the model.
