| 摘 要： | 商业银行公司治理，需要通过各种具体的法律制度构建来实现。监管机制及其法律制度完善在商业银行公司治理中具有重要的意义。国际商业银行监管模式经历了行政命令式规制、标准化方法规制以及目前普遍采用的内部模型规制。完善我国商业银行的监管需要从以下几个方面着手：第一，借鉴国际商业银行监管及立法先进经验，构建完善的监管制度体系。第二，商业银行监管机构应该明确自己的监管职责并认真落实。第三，监管机构应该特别注意完善相关的评价机制。
