和谐社会构建中“以人为本”思想的法理解读

随着"以人为本"思想的提出,加大对马克思主义的法的价值论的研究并用来指导我国的法治建设显得尤为必要和重要,马克思"以人为本"的法哲学思想主要体现在:"以人为本"的法,应以普遍的人性为本、以自由为本、以权利为本、以个体为本。在此意义上说,法治的道德起点和最终归宿就是人本身,因此法治作为人类社会的一种制度,法治的历史便是人类对自己本身认识的历史,是追求人类自我解放和人的价值的历史。

As the presentation of ＂People-oriented＂ thought,it is important for us to enhance the study of Marxist law axiology to direct the law.Marxism law philosophy of ＂People-oriented＂ thought mainly embodied by its law of ＂People-oriented＂.It pays much attention to humanity,freedom,right and individuals of people.In the sense,the initial point and ultimate purpose of the law are human.So,as a social system,the history of law is the history for people to understand themselves and to pursue self-liberation and human merit.
