| 摘 要： | 法律制度移植的产生有历史、经济及现实等多方面的原因,对于构建我国市场经济法律制度来说,如何发挥移植法律制度的绩效是一个重要的现实课题。要发挥移植法律制度的绩效就必须在法律自身的适应性、制度环境的完善、配套法律制度安排和非正式规则与文化建设等方面作出努力。

| Abstract: | The transplantation of legal system originates from the historic- economic and realistic requirements,which evolves in different patterns in the original nations and the nations transplanted. It is an important project to improve the performance of transplanting legislation in the establishment of legislation of china's market economy. The performance of the transplanted legislation is mainly influenced by the factors such as the source of law and its adaptability- the institutional environment- the institutional arrangement- the dependence on route and the immigrants. We should make an effort to improve the adaptability- perfect the institutional environmental arrangement- necessary legislation- informal regulations and cultural construction. |
