“法院财政独立”从何入手:基于实证检验的政策建议

法院独立以实现公正、效率为宗旨 ,而不是为了独立而独立。作为一种实现司法公正的手段 ,法院独立只能是相对的 ,它必须符合一国的政治、经济制度 ;各级法院也必须对人民负责 ,受人民监督。针对目前司法学界提出的“法院财政独立”主张 ,本文将通过经验分析 ,对我国法院财政独立假设的有效性进行实证检验 ,在此基础上 ,提出相应的政策改革建议。

How to Realize"Independent Judicature Finance":Policy Advice Based on Empirical Analysis

Judicature independence is not an end, but a means to realize justice and efficiency. It must be in conformity with the political and economic institution; courts at all levels must answer people and be supervised by people. Aiming at the “judicature independence" given by domestic jurists, this paper offers some advice based on the empirical analysis.
