农民土地权利的政治经济学分析

农民权益实现的根本在于农民的土地权利。保障农民权益的实现首先要明确农民土地所有权的归属，由农民自主成立集体经济组织，代理农民掌握土地所有权。在土地所有权归属尚难确定条件下，切实依法保护农民的土地承包经营权，明确承包经营权的内容，农民土地承包经营权不可侵犯。在征地时，只有在“公共利益需要”时政府才是征地主体，非公共利益需要征地，政府不能直接插手，只起管理监督作用。征地必须给予合理补偿，要充分考虑到级差地租Ⅱ，借鉴国外经验。

Analysis on Plutonomy of Farmers' Land Rights

Realization of farmers' rights relies essentially on farmers' land rights.In order to guarantee realization of farmers' rights,we should first of clarify the ownership of farmers' land,and allow farmers to set up their own collective economic organizations to hold the land ownership on behalf of farmers.If the land ownership can not be easily clarified,we should protect farmers' rights to operate on contracted land according to the laws,clarify the contents of farmers' rights to operate on contracted land,and make inviolable farmers' rights to operate on contracted land.Government is the main body responsible for confiscating farmers' land only if there is a need to do so for the sake of public interests.If land is confiscated for the sake of nonpublic interests,government should play the role of management and supervision rather than intervene directly.We should make reasonable compensations for confiscation of land,fully take into account the second differential land rent,and use for reference foreign experiences.
