论循环经济法基本原则的构成

法律原则作为法哲学和部门法中的一个重要范畴,其基本原则不仅体现法律规则和法律制度的基本目的,更对立法、执法、司法、法律监督等法制环节的建设具有重要的指导意义。一直以来,理论界对循环经济法基本原则确立的方法或标准少有研究。循环经济法作为环境法的特殊部门法,应当有自己独立的基本原则,并且通过独立的基本原则反映环境法的基本原则。我国循环经济法基本原则应当确立为减量化、再利用和资源化原则和共同责任原则。

The Composition of Fundamental Principles of Circular Economy Law

As an important category of the philosophy of law and department law,legal fundamental principles not only reflect the basic mission of law and legal system,but also direct the legislative,law enforcement,judicial,legal supervision.Until now in China,there are few studis about the methods or standards of fundamental principles of the circular economy law.So as a department of environmental law,circular economy law should insist on the fundamental principles of environmental law.However,under the fundamental principles of environmental law,the circular economy law also has its own fundamental principles.With the analysis of this,it is considered that the fundamental principles of the circular economy law are principle of 3R and principle of shared responsibility.
