| 摘 要： | 回顾了中国实践中已经采用的"征用有偿、管护无偿""征用无偿、管护有偿""征用无偿、管护无偿"3种补偿模式,提出了完善森林生态效益补偿制度的6个具体措施,即由国务院制定行政法规《森林生态效益补偿条例》;依据2004年《宪法修正案》、2007年《物权法》确定"征用有偿、管护有偿"的补偿模式;明确中央与地方政府承担森林生态效益补偿资金方面的责任;修改《森林法》,明确森林生态效益补偿资金的开支范围;先补偿后征用;征用补偿实行分类。

| Abstract: | Reviews the three kinds of compensation models of“expropriation paid,maintenance free”“expropriation without compensation,maintenance paid”and“expropriation without compensation, maintenance free”in China. Puts six main measures of reform of the current system of forest ecological benefit compensation:administrative regulations formulated by the State Council,the Forest Ecologi-cal Benefit Compensation Ordinance;based on 2004 Constitutional Amendment and 2007 Property Law,determines compensation mode:expropriation compensation,maintenance paid;explicits cen-tral government,local governments bear the forest ecological benefit compensation funds responsibili-ties;clear forest ecological benefit compensation fund expenditure range;first compensation before expropriation;requisition compensation of category. |
