摘    要:当前我国农村土地的发展权实质上归属于国家所有,集体建设用地流转是农民集体争取土地发展权及其收益的体现。农村土地发展权的设立与配置是十分必要的。文章通过分析与借鉴国外土地发展权制度的实践经验,对我国农村土地发展权制度进行了设计与构建,主要内容包括农村土地发展权的归属、农用土地发展权配置、集体建设用地发展权配置、农村土地发展权流转、对农村土地发展权的管理等五个方面。

Abstract:Rural land development right at present in China actually belongs to state.The transfer of collective building lands reflects that farmer collective strives for land development right and its income.It is necessary to set up and distribute rural land development right.The paper analyzes overseas system of land development right,uses the experience of other countries for reference and draws up the system of Chinese rural land development right.The main contents include:the ownership of rural land development right,the distribution of rural land development right,the distribution of collective building land development right,the transfer of rural land development right and the management of rural land development right.
