摘    要:农村住房商品化有利于发挥物尽其用的价值,有利于推进新农村的建设。然而,现阶段农村住房是不能作为商品流转的。文章分析了制约农村住房商品化的相关因素,如农用地的匮乏、城乡二元结构的存在、农业生产效率的低下、农宅交易规则的缺失等。在此基础上,文章探寻了农村住房商品化的可行性,进而提出了规范农宅流转的立法建议:明确农宅商品化改革应遵循的基本原则,清晰界定农宅的市场准入条件,明确农宅流转应遵循的交易规则,完善农宅流转收益的分配机制。

Abstract:Commercialization of residence in the rural areas is of significance for developing the socialist new countryside. But at the present stage, residence in the rural areas is prohibited for rutening. This paper analyzes factors about rutening, such as the shortage of arable land, low productivity effect. Then, it studies the feasibility of residence ruten. After that, this paper proposes some suggestions: definite fundamental principle and specific transaction regulation, perfect the relation of interest distribute.
