完善我国家务劳动补偿制度的法律思考

2001年修订的婚姻法第四十条确立了家务劳动补偿制度,这对维护妇女的合法权益,促进社会公平,强化家庭责任意识都具有重要意义。但该制度存在适用前提过于狭窄,行使时间限制严格,法律规定操作性差等缺陷,借鉴国外立法和我国实际,适用前提上不管夫妻对财产是否有约定,也不管约定的内容如何,均可行使家务劳动补偿请求权;行使时间上任何一方均有权在婚姻关系存续期间或离婚时行使;法律上应明确家务劳动的价值以及具体参照因素。
