BOT融资中的风险分担及合同管理

目前，BOT项目融资方式是一种颇具吸引力的利用外资的新形式，采取这种融资方式可以缓解基础设施建设资金的不足，改善本国的投资环境。但BOT融资模式在我国的应用还处于起步阶段，成功的案例较少，经验不足，与宏观经济、政策制度环境不相适应使项目运作中的风险加大。如何设计该融资方式的合同来分散风险，达到各个参与主体的利益均衡，是目前我国推广BOT项目融资模式面临的主要问题。

Risk Diversion and Contract Management in BOT

Recently the financing model of BOT has become a quite attractive pattern of using foreign capitals, with the advantage of meeting the necessary of cash for building and improving the native investment condition. The applying of BOT has made little access in the first stage because of the lack of experience and the conflict with the macroeconomic environment. Now the most important problems in applying are how to design the BOT model to scatter risks and proportion behalf in relatives. This paper discuss the BOT'S characteristics, sorts of risk and carrying; also the management of contract and give some advice in BOT.
