监管权的纵向配置--来自电力、金融、工商和药品监管的案例研究

本文主要讨论的是，在现有单一制和集权型政体模式下，若干特殊行业实行一种新型的垂直或半垂直行政监管体制的可行性。调查表明，现有行政机构的纵向设置(如药监和工商管理的省以下垂直)和纵向性的横向整合(如银行、证券、保险监管的大区派出)，在实际执行过程中困难重重，或中途而废，或以失败而告终。笔者以为，这与我国党政不分、政企或政资不分以及公共财政制度缺失有关。这些制度虽然形成于计划经济时期，但并未结合市场经济体制的逐步建立而作出根本性的调整，反而继续扭曲着我国政府间的关系。

The Vertical Setting of Regulatory Power --A Case Study of Electricity, Banking, SAIC and Pharmaceuticals

This paper study the possibility of establishing a new-style vertical or semi-vertical administrative regulation system in some special industries under present polity of singularity and centralization. From the investigation, I found that the vertical setting(for example, pharmaceuticals)and the vertical-horizontal conformity(for example, bank, security and insurance)of administrative agency at present are all being in very difficulty or existing in name only. The main reasons I think are the integration of party-government-enterprise and the lack of public finance. These institutions were formed in planned economy days, but they are not adjusted fundamentally with the working up of market economy , on the contrary, they continue to distort the relationship among governments in our country.
