现代司法理念与申诉审查听证制度的构建

在"轻程序,重实体"的司法观念支配下,我国至今尚未建立申诉案件审查的具体程序制度,致使申诉案件审查陷入放任无序状态。申诉审查的结果,无论是决定再审,还是驳回申诉,实际上又都是对案件的实体处分。因此,探索和构建申诉审查案件的程序制度,对于保障当事人的诉讼权利,维护司法公正具有重要意义。本文笔者围绕"中立、平等、透明、公正、高效"的现代司法理念,从分析我国申诉制度的特点、缺陷入手,提出了构建申诉审查听证制度的基本原则和一些具体操作规范,以期通过合理的法律程序制度,摆脱当前困扰法院审查申诉案件无程序法可依的矛盾。

odern Judicial Concept and Hearing System Construction of Complaint Review

Under the control of the judicial concept of ＂simple procedures, focus on entity＂, China hasn＇t yet established a specific procedure to examine a ease, making a complaint review case in disorder. The result of complaint review, whether it is retrial or dismissal, calls for the disposal of case entity. Therefore, to explore and build a system of complaint procedures for examining the case is of great significance for the protection of the litigation rights of the parties, and safeguard judicial justice. On the basis of the modem judicial system of ＂neutrality, equality, transparence, fairness, and efficiency＂, this article analyzes the characteristics of our complaint system and its shortcomings, puts forward the basic principles of a complaint review hearing system and some specific operating specifications in order to put a complaint review case in order.
