| 摘 要： | 从经济史的演进入手,结合我国的体制变革,从制度变迁的角度对经济法的价值问题做出了重新思考,克服了以往学界对这一问题的探讨更多的是沿用法理学的概念和体系,而欠缺学科自身的理论构筑的弊端,并在市场和政府的互动中推导出体制效率应是经济法的根本价值这一结论。

| Abstract: | Taking measures from the evolvement of economic history,combining the system transformation of our country,rethinks about the value of economic law in view of system change,overcomes the obstacles before,which are probed into this problem with the concept and system of law theory,was short of the theory structure of itself.Draws the conclusion that efficiency of system is the basic value of economic law in the mutal action between market and government. |
