从国际经验看中国反垄断私人执行制度的建立

我国《反垄断法》对私人执行制度只做了原则性规定。我国应重视私人执行制度的发展,使其成为公共执行制定的有力补充。在私人执行具体操作模式上,我国可借鉴多数国家的经验,选择直接执行模式。在私人执行救济方式上,我国可借鉴欧洲国家的经验,选择单倍赔偿制度和禁令制度并举的救济方式。

Comments on the Establishment of Chinese Anti-Monopoly Private Enforcement System from the Perspective of International Experiences

China's anti-monopoly law only provides the private enforcement system simply. China should attach importance to the development of private enforcement system which shall become a strong complement to the public enforcement system. As to the operation mode of the private enforcement system, China may choose the direct execution mode. As to the remedy mode, China may choose the single-fold compensation system and the ban system.
