| 摘 要： | 《中华人民共和国民事诉讼法》对执行异议制度进行了修订。修订后的制度更加严谨，对提高执行效率有很大的作用，但对当事人不服执行异议裁定时的救济程序规定的较为含糊，对非善意当事人恶意诉讼造成执行拖延亦缺乏制约和惩戒机制，容易造成实际操作时的误解和被非善意当事人利用。应寻求当事人诉讼权利的均衡，构建不服执行异议裁定的救济制度，以体现公正价值。

| Abstract: | ＂Civil Procedure Law of the People＇s Republic of China ＂ is revised about the implementation disagreement system in the 204th. The system revised is more rigorous , efficient to improve implementation, but it is ambiguous in procedure of the redressment when one party refuses to follow, it can＇t restrict and punish effectively when the party suit spitefully, it easily produces misunderstanding . The author tries to comment on principle combining with Nash＇s Equillibium Thoery, trying to reach a kind of least balance in forms, striving for relief system to reach the justice that it is sufficient, equal, harmonious |
