知识产权制度与非物质文化遗产法律保护的冲突与契合

非物质文化遗产在其产生、发展和运用等方面不具备足够的广泛性，通常通过口传身受等方式延续，没有形成固定的知识集合或知识片段，因此，其自身存在着若干难以规范和保护的问题，其内容也不符合法律对知识产权保护的传统标准，因而运用知识产权制度解决非物质文化遗产的法律保护问题存在一定的障碍。但知识产权制度不是一成不变的，随着社会的演进而发展变化，非物质文化遗产的知识财产特性，以及作为智力劳动成果的属性，决定了知识产权保护的必要性和可能性。二者既相契合又相冲突的关系致使知识产权制度下的非物质文化遗产法律保护问题有待深入研究。
