商品房承购人知情权及其法律保护

摘    要:商品房销售(预售)中商品房承购人无论是否自然人,只要不是经营商品房买卖,相对于开发商这一经营者而言均属于消费者,享有充分的知情权。开发商欺诈情形下损害承购人知情权时应承担的法律责任包括惩罚性赔偿责任。

Abstract:The buyers who purchase commercial estate are belong to the consumer who are compared to the real estate developer in terms of the operators whether or not buyer is the individual.As long as buyer is not commercial estate' business.Buyer should have adequate consumer's right to Know of Consumers.The developer who have fraud the buyer of commercial estate should bear legal responsibility which including punitive damages.
