| 摘 要： | “授权经营”的初始目的和根本目的是为了解决国有出资人的缺位问题。那么,在国有出资人代表者(即国资委)真实确立后,“授权经营”理论无疑已变得不合时宜。其实,所谓的“授权经营”只是委托代理的一个变称,只不过其受授之权比其他非“授权经营”模式的授权度更大一点而已,而委托代理关系的实质并没有改变。

| Abstract: | The preliminary and fundamental purpose of "authorized operation"is to resolve the absence of investors of state-owned assets.But,after the representative of state investors,the commission of supervision and administration of state-owned assets,has been truly established,"authorized operation"becomes incompatible with current times.The so-called"authorized operation"is another name for agency by agreement.Actually,the nature of its agency relation remains unchanged while its authorized rights are a little bigger than others. |
