| 摘 要： | 按照现行法律法规、规章,在集体所有的土地上建设的小产权房是违法的行为,城市居民作为购房人不可以请求债务人履行义务,只能有不当得利的请求权.但法律实证主义绝对化易形成"恶法亦法"现象.所以当恶法影响甚众时,仍以法律实证主义剖析现实问题可能并不妥贴,因此继续完善相关制度以解决小产权房问题.
