中国反垄断法的竞争秩序价值实用化研究

在经济性垄断、行政垄断等现象频繁出现的今天,为规范政府权力运行、加强对国家经济的调控力度以及保障社会公共利益,针对竞争秩序价值未得到较好实现的具体情况,立法机构应积极完善中国反垄断法并应陆续出台相应的配套措施。着重阐述了竞争秩序价值未得到较好实现的具体情况以及促进竞争秩序价值实现相应的法律措施,并从促进反垄断法其竞争秩序价值实现的角度,提出自身的建议,以期为立法者所采纳、有益于法律的进步与完善。

Practical Research of the Competition Order Value of Chinese Anti-trust Law

Monopoly in economy and administration frequent appears today .In order to regulate government power and strengthen efforts to control the national economy and protect the public interest ,legislature should improve anti-trust law actively and formulate appropriate complementary measures gradually for specific circumstances of the competition order value .In this article,the authors focus on the specific circumstances of competition order value that not get better realization ,and on the appropriate legal measures value which can promote the competition order value to be achieved .From the promotion of competition order value of antitrust law perspective ,some suggestions are put forward for legislators to adopt them improve the law .
