“大一统”国有制局限性刍议

通过法学视角的讨论,认为赋予地方政权所有权地位的制度创新,有利于以下问题的根本解决:地方政权无所有权地位;国有制内部不同利益主体难以确立;因“所有者缺位”引起国有资产流失;地方政府融资的困难和权利义务不对称影响其积极性的发挥等等。

On the Limitations of "the Highly Centralized" State-ownership

Through some discussions from the perspective of law,the author hold the opinion that providing the local governments with the recognition of their ownership would help to solve the ensuing problems thoroughly,such as the lack of local ownership,the failure of defining the interests holders within the state-ownership system itself,the loss of the state-owned properties as a result of "the lack of ownership",the local governments' financial deficits,and the disparity between their duties and rights which leads to their inability to be active in the economic development.
