| 摘 要： | 环境刑事责任实现方式一般划分为刑罚方式与非刑罚方式。环境刑事责任的实现方式主要体现了两个发展趋势：在刑罚措施上财产刑将取代自由刑扩大适用,相应的资格刑也将不断引入适用,这是其一;其二,以刑罚措施为基础,非刑罚实现方式将在环境犯罪中越来越多地得到适用。而非刑罚化的发展趋势更是现代刑法转制的新方向。

| Abstract: | Environmental criminal penalties implementations are usually divided into penalty method and non-punitive approach.Environmental criminal way to achieve is mainly reflected in two trends：the imposition of penalties on the property would replace the criminal penalties extended freedom,and the corresponding penalties will also be eligible to apply to continue to introduce,which is one;secondly,based on punitive measures,non-punitive manner to achieve the environmental crimes are increasingly being applied.Rather than the penalty of the development trend is the new direction of modern criminal conversion. |
