试论新疆反恐刑事政策的法治化

近年来,我国积极参与国际刑事法治的交流与合作,并注重对国际上"轻轻重重"两极化刑事政策的借鉴与吸收。宽严相济刑事政策的提出,就是对两极化刑事政策的理性回应。新疆反恐刑事政策的法治化顺应这种趋势,既是新疆反恐的现实需要,又有相应的法理基础和法律依据。在刑事立法、刑事司法中明确体现宽严相济刑事政策和罪刑相适应原则,整合本土资源控制新疆恐怖主义犯罪,是新疆反恐刑事法治化的正确选择。

On the Rule of Law of Crime Policy of Anti-terrorism in Xinjiang

In recent years,China participates in international exchanges and cooperation of crime rule of law actively,and pays attention to drawing lessons from international crime policy of "lightly layer after layer and heavily layer after layer".Put forward the melting crime policy of leniency and strictness which is reasonableness response to the crime policy.The rule of law crime policy of anti-terrorism in Xinjiang turns conformance to this kind of trend,since it is the reality demand of anti-terrorism in Xinjiang,and then have homologous legal theory foundation and law basis.Showing the melting crime policy of leniency and strictness and the principle of Commensuration of Crime and Punishment explicitly in the pertaining to crime lawmaking and pertaining to crime judicatory,integrating a native resources and controlling crime of terrorism in Xinjiang,is the exactitude choice of anti-terrorism of Xinjiang.
