| Abstract: | The phenomenon of joint infringement acts often occurs in the market oriented economy. Joint infringement is characterized by it commonness, compared with general infringement.To the commonness in joint infringement, no distinctive definition has been given in both legislation and judicial explanation and no common recognition has been reached in theory. This has brought much trouble to judicial practice. This essay, with some real cases, discusses the basic features of joint infringement in theory and judicial explanation,so as to have a clear understanding of it. |
