| 摘 要： | 《物权法》的颁布实施是我国金融业运行环境的重大法律变革,它既为金融创新提供了新的动力,也可能引发新的金融风险.如何防范和化解新规定、新业务所带来的新风险,维护金融安全,促进金融效率,成为《物权法》实施后金融业所面临的一个重大课题.要结合我国的经济社会条件,稳妥地推进金融创新,同时健全金融法制.加强金融监管,公正合理司法,以达到金融安全和金融效率的平衡.

| Abstract: | The enact and enforcement of Real Estate Act is an important legal reform for financial environment in our country, which not only is a new impetus to financial innovation but also probably brings about new financial risks. So we must be aware of the advantages to financial industry while keen on safeguarding and resolving possible risks. In order to achieve the balance between financial safety and financial efficiency, financial innovation should be implemented step by step; financial system and financial regulation should be improved; the application of law should be fair. |
