| 摘 要： | 用经济学原理分析诉权保障问题,有助于更好地进行制度设计.应确保司法正义,以降低社会治理成本;确立科学的诉讼费用制度,以排除接近司法的经济障碍;优化诉讼程序的设计,以提高司法效率;构筑多元纠纷解决机制,以减少诉讼垄断的弊端;规制诉权滥用,以建立依法行权的制度激励.
