| 摘 要： | 在发生责任竞合时，如何处理违约责任与侵权责任的竞合，如何在违约责任与侵权责任中进行取舍，将影响到对受害人利益的保护和对不法行为人的制裁。在违约责任和侵权责任竞合的情况下，应最大程度地保护当事人的利益，捍卫社会秩序与公平。
