"贸易制度统一性条款"刍议

"贸易制度统一性条款"是我国入世文件中被置于显著地位的重要承诺.它主要是指:必须在关境内实施统一的贸易制度、政策和基本措施;而我国地方各级政府和特殊经济区尤其需要认真对待之.该条款的设立,是WTO非歧视原则的自然延伸和现代市场经济运作的基本要求,也是WTO规则体系中的一个重要原则,可它始终在我国的具体经济实践中被严重忽略.我国要正确把握和履行该条款,必须大力纠正偏好"优惠做法"、误读"经济特区"和曲解"特殊政策"等的理念偏差,以及有些地方政府的行为偏差.

Comment on the "Trade System Unity Clause"

The "Trade System Unity Clause" is an important commitment placed in prominent status in the documents about China's entry into WTO. It mainly means that the government must carry out uniform trade system, policy and fundamental measures in the customs frontier. And the local governments and special economic zones of China should especially take serious attitudes towards it. The establishment of the clause is the natural extension of the "non-discrimination principle" of WTO and the basic demand of modern marketing economy operation, and it is also one of the important principles of WTO regulation system. However, it is always neglected in the economic practices of our country. In order to understand and implement the clause correctly, we should rectify the conceptual errors such as the preferring of "preferential practice", the misunderstanding of "special economic zone", and the distortion of "special policy", as well as the incorrect behavior of some local governments.
