| 摘 要： | 违宪审查制是美国对宪政理论的独特贡献,是美国宪法中一项极为重要的原则。它起源于美国独立运动领袖的自然法观念和分权思想,具有既基于宪法和“三权分立”而产生又受限于二者的基本特征,在监督宪法实施、捍卫宪政精神方面有着特殊的功效。

On the Principles of the Unconstitutional Investigation System of American Constitution |

| Abstract: | Unconstitutional investigation system is American unique contribution to the constitutional theory and it is also an important principle in American constitution. It is originated from American independent war leader's ideas on nature and power-division-thought. It has the basic features of basing on constitution and being confined by the two. It is of great help in supervising its implement and upholding its spirits. |
