土地征收成片开发的制度架构与风险控制

研究目的：通过梳理土地征收成片开发的制度架构及潜在风险，探索控制成片开发征收风险的可行路径。研究方法：规范分析法、演绎法。研究结果：新《土地管理法》第45条第5款确立的土地征收成片开发制度，一定程度上消减了学界对土地成片开发的质疑，但其并未解决成片开发制度的适用和规范难题。现有制度设计对土地成片开发的控制性不足，成片开发中的非公共利益存在使成片开发功能发生异化偏移的风险。研究结论：应从内容、过程及结果三个维度对土地成片开发进行风险控制：内容控制上，应建立成片开发公共利益的动态认定机制；过程控制上，在保证公众参与权利的同时，应将公众参与限定在初次决策过程之中；结果控制上，应畅通当事人的救济渠道，当事人可通过质疑、行政复议以及行政诉讼等方式寻求救济。

Institutional Structure and Risk Control of Land Expropriation for Integrated Development

The purposes of this paper are to explore the feasible path of risk control for integrated development by sorting out the institutional structure and potential risks of land expropriation for integrated development. The research methods include normative analysis and deductive approach. The results show that the newly amended Article 45(5) of the Land Administration Law establishes the system of land expropriation for integrated development, which responds to the queries of the academics about this issue, but the difficulty of its applicability also emerges. The existing system has insufficient control over land expropriation for integrated development and there is a risk that the non-public interest will alienate and deflect its function. In conclusion, there are three dimensions towards controlling the risk of land expropriation for integrated development, i.e., content, process and outcome. In terms of content, a dynamic mechanism for identifying public interest should be established. In terms of process, public participation should be limited to the initial decision-making process while ensuring the right of public participation. In terms of outcome, the avenues of redress for actors to ensure that they can seek redress through challenges, administrative reviews and administrative litigation.
