| 摘 要： | 中国加入WTO前夕,已对我国外资基本法进行了修订,其中关于当地成分要求、外汇平衡要求、产品出口要求、进口替代要求和销售比例要求等为TRIMs协定所禁止的投资措施均被删除。然而,我国外资法中还有某些与WTO规则要求不符的投资措施,特别是外资税收优惠措施,亟待我国对其加以统一和完善。文章在分析我国外资措施立法存在问题的同时,提出了我国外资措施立法“适世”的几点建议。

| Abstract: | On the eve of China's entry into the WTO, it had made revisions of and amendments to the laws on foreign investment
and those anti-TRISP-agreement stipulations on local content, exports, import substitution and sales percentage thereof are deleted.
However, some more anti-WTO-rule stipulations exist in the foreign investment laws, especially the tax preferential items, which
need to be consistently improved. The paper, based on the analysis of the problems in legislation on foreign investment, advances
some suggestions about "WTO conformations" in the aspect concerned. |
