我国普通遗嘱要件规则的立法完善

我国《继承法》对普通遗嘱的要件规则作出了规定，但现有某些规定存在明显不足。应当从我国新时期调整继承关系的实际需要出发，在借鉴国外和我国港澳地区成功立法经验的基础上，通过规定设立遗嘱的形式标准和程序、对录音录像遗嘱的制作和使用加以严格限制、完善见证人资格制度等多方面对我国《继承法》进行全面的修订和补充。

On Perfection of Legislation on Effect of Ordinary Will in China

Terms concerning about forms and effect of ordinary will are specified in Inheriance Law in China,which still exist some obvious disadvatages.Comprehensive adaption and supplements should be made based on the current need to adjust inheritance relationships,referring to the successful legislation experiences in Hong Kong,Macao,and the foreign countries,by setting standard for will forms and procedures about setting up a will,placing strict limitation to taped will and video will,and perfecting the stipulation about the qualification of witnesses.
