加入WTO十周年:中国参与争端解决机制的宏观问题和应对之策概析

2011年是中国加入WTO十周年。在过去10年中,中国参与WTO争端解决机制逐步深入,当前已成为主要参与者,成绩来之不易。在此过程中,中国不仅需处理具体案件中的问题,还不断面临一些制度层面挑战。本文从认知态度、能力建设、政企互动三个方面考察了中国在加强参与和利用WTO争端解决机制方面所可能面临的一些内部宏观性问题、采取的应对之策、付出的努力和取得的成绩。

Tenth Anniversary of VVTO Accession: Problems of China's Participation in Dispute Settlement and Responding Measures

2011 is the tenth anniversary of China＇s accession to the WTO. During the past ten years, China gradually enhanced its participation in the WTO dispute settlement system and is now a major player at the WTO. This achievement does not come easily. In this process, China not only needs to handle legal and factual issues in various specific disputes, but also to face and tackle several systemic internal challenges. This paper studies three general internal problems facing China＇s enhancing participation and utilization of WTO dispute settlement system from ideological attitude, capacity building and government-industry interaction perspectives and analyzes China＇s endeavors to respond these problems and achievements thereof.
