建立城市污水与垃圾处理监管体系的新思路

指出我国目前的环保监管体系难以适应污水与垃圾处理市场化后的监管要求,其根本弊端是行政执法职能与日常监督职能集于一身的制度安排,容易弱化环境执法的公正性与有效性。因此,建议将项目建设的第三方监理制度引入环境产业的经营监理中(而不仅仅是项目建设阶段),形成“环境监察(执法)—第三方环境监理(监督)—企业经营”的三层次管制体系。这种新的监管体系能更好的协调企业、执法者、公众之间的利益关系。

New way of the supervision system on treating sewage and garbage disposal in urban areas

This paper points out that the existing environmental protection supervision system in China cannot adapt the supervising requirements after the marketability of the sewage and garbage disposal.The essential abuse is the institutional arrangement,which is composed of administrative function and supervisory function together,is easy to weaken the equity and efficiency during the environmental law is being executed.Therefore,it is suggested to introduce a third one who takes the supervision work in the environmental industry,which forms a new supervision system to harmonize the benefit relationship among corporation,lawmen and public.
