市场经济条件下对我国自然垄断规制的思考

在科技进步的冲击下,传统自然垄断行业发生了一系列变迁,致使传统规制方法难以应对。这一状况在我国已加入WTO的形势下日显严峻。而勾勒规制新轮廓、提倡规制新思想无疑是解决问题的一剂良方。笔者认为,应借鉴国内外相关规制经验,在变迁中合理搭建规制平台,细化各种规制手段和方法及其运作程序,以实现结构与内容的整合和各种规制方法与手段的良性互动,从而消除自然垄断的负面效应,发挥其积极作用。

Consideration of Rules to Natural Monopoly in Market Economy of China

With the impact of the development of science and technology, a series of changes have taken place in the traditional natural monopoly industry, which makes it difficult for the traditional rules and regulations to control it. After China entered WTO, the problem becomes more and more serious in our country. Undoubtedly, it is imperative to set up new regulations and propose new ideas. Therefore, China should absorb regulatory experiences from other countries and consider changes in the regulations. All the regulation, methods and operating procedure must be specified, in order to realize the harmonization of structure and content and the reaction between regulation means and methods. Thus, the defect of natural monopoly can be removed while its advantage will be brought into full play.
