建筑施工企业劳动合同管理之我见

摘    要:建筑施工企业劳动用工具有人员流动性大、工作时间不固定及临时合同工用工多等特点。新《劳动合同法》对劳动合同必备条款进行了增减,对违约金的设定作了限制,扩大了无固定期限劳动合同签定范围等,对建筑施工企业的劳动用工管理带来了很大影响,让劳动合同管理作为企业规范合法用工的制度管理,显得尤其重要。文章结合笔者工作经历及其对所在企业劳动合同管理的认识,提出了几点建议。

Abstract:High mobility, flexible working time and large quantity of temporary workers are the major characteristics of Workers employed by construction enterprises. The new Labor Contract Law modified the essential terms, set limit on the damages and expanded the scope of open-ended work contracts, having an important impact on the management of workers. In this sense, it is all the more important to take management of labor contract as a way to regulate the lawful use of worker of construction enterprises. This article puts forward a number of suggestions according to the writer's experiences and understanding of labor contract management of the enterprise where he now is working.
