| 摘 要： | 不动产与动产的划分在物权法上一向重要，罗马法、法国民法、德国民法都有其划分标准，并表现出各自的法律意义。然而不动产、动产作为对物权客体的固定划分模式，其划分标准从来就是一变再变的，基于此状况的反思，孟勤国教授提出了新的标准，即以登记标准作为统一的标准来明定二者界限。辩证的评判这些传统标准和孟勤国教授的登记标准，发觉各有特定的局限性，但仍能给人以启示。
