| 摘 要： | 随着我国经济的快速发展，每年有大量的农地被侵占。基于此，学术界提出了在农地产权中创设农地发展权来解决当前的问题。目前对于农地发展权的讨论还处在初级阶段，学术界观点各异。笔者试图界定农地发展权的概念、设定农地发展权和分析该项权利属性，并在此基础上对该项权利的共享实现进行构架，以期实现在保护农地的基础上使农民的权益得以实现，从而实现全社会效益的最优化。
