基于物权规则的国有资产监管问题

在《物权法》中确立"平等保护"这一物权规则是构建和谐社会的必然要求。"平等保护"对于国有资产监管,既有机遇,又有挑战。就转型期的基本国情而论,应在平等保护原则之下,针对公用性国有财产以及资源性国有财产的特殊性,做出相应的特殊规定,以示例外;同时,应在其他的部门法中进一步完善有关国有资产监管的规定。

On the Issues of National Assets Supervision and Administration Based on Property Rights Principles

It is inevitably required to establish the article equal protection in the Property Rights for the construction of the harmonious society.The equal protection is both chance and challenge for the national assets supervision and administration.It is necessary as an exception,worth noting the fundamental realities of China in the transformation period of the society,to make relatively specific regulations under the principle of equal protection for the peculiarities of public national property and resourcing national property;and it needs to make improvement to the regulations of national assets supervision and administration in the other departmental laws.
