| 摘 要： | 法的功能具有客观性,法的功能选择的状况直接影响着法的价值的实现。法律的功能范围是不断发展完善的,这要求法的主体应该依照不同的社会状况选择适合社会现实的法的功能组合才能实现法的价值追求。现实中,为保证能源安全目标的全面实现,立法者需要综合考虑影响能源法功能选择的思想、实践及法律等基本因素。
