| 摘 要： | 举证责任和证明责任是两个紧密联系又相互区别的法律概念,公安机关、检察机关在立案侦查阶段和提起公诉阶段承担的责任是举证责任与证明责任的统一,人民法院对刑事案件承担着最终的证明责任.
