| 摘 要： | 公共企业具有公共性和企业性的双重特征，其应以利益相关者治理模式进行治理。针对公共企业的特征，建立企业的内部组织体制和外部监督法律制度，赋予利益相关者诉权，是实现公共企业法律规制和建设有中国特色法律体系的必由之路。

| Abstract: | Due to the specialties of public and enterprise characteristic,public enterprise is more in keeping with to choose the mode of stakeholder governance.Being aimed at the specialty of public enterprise,to establish an interior organization system and exterior interposing system of public business and to give stakeholder litigation right is the necessity to realize the legal regulation of public enterprise and construct a legal system with Chinese characteristics. |
